Child Support Overhaul Policy
Love Australia or Leave Party Believes that Australia’s Child Support Agency is in urgent need of a major overhaul.
Australia’s Child Support Program (CSP) has now been operating for over a twenty five years. During the course of its life, over $45 billion of child support payments have been transferred from one parent to another. Today, around 1.3 million parents are clients of the program, with payments transferred to support the raising of about 1.1 million Australian children.
The Child Support Program (CSP) was set up to provide administrative support, advice and financial adjudication for separating parents. The CSP claims to be a significant social services program to assist families with advice on family law and taxation streams, delivering services on behalf of some 1.1 million children.
The Child Support Agency has become a nightmare for many, a system supposedly set up to assist separated parents, yet it is evident that the CSP is causing more harm then good. It is also evident that the parent receiving the money has more rights than the payer. The system is extremely unfair and biased.
The most common complaints by parents (mostly fathers), especially those who have new families to support, are that they are paying too much, they shouldn’t have to pay child support when they can’t see their children, and that child support is essentially a form of alimony.
For most dads, 50/50 parenting is a distant dream as they live the nightmare of being separated from children they love and desperately miss. Men make up more than 90 per cent of parents paying child support.
Equally, there are those who have experienced appalling treatment from a system which claims to service the best interests of all stakeholders - mothers, fathers and children.
Children should never be used as leverage, emotional or otherwise, and the ability for parents to be able to do so needs to be removed.
In the the event of deliberate alienation of the non-custodial parent the prosecuting authorities shrug their shoulders, but the maintenance order is cast in stone. However, Love Australia or Leave Party will link visitation to maintenance - if the mother or the father does not allow the child to visit, or if "the child doesn't want to" (instigated by the mother or father), penalties will be imposed on the receiver of the maintenance.
Love Australia or Leave Party will lobby that Maintenance payments are to cease if the parent refuses to grant access of the child.
The cost of children should be fixed and should NOT be dependent on the level of income of the parents. The current formula and methods used by Child Support to collect payments is drastically flawed as it is assumes that it costs more for parents on higher incomes to raise their children. However, the reality is it does not cost anymore to buy the basics, such as a carton of milk or bread depending on income. It makes no sense that the cost of raising children is deemed to vary depending on ones income.
LAOL will introduce a Child Support Card whereby only nominated services in agreement by the payer, on where and what the card can be used, for purchases and needs of their child. In other words the payer gets 100 per cent say on where and how their payments are allocated.
Child Support payments via the Child Support Card will be subject to the same “income management” regime used to protect welfare payments, to ensure it is spent on the children's care.
There are those who are in receipt of payment who believe they have the right to purchase cigarettes, alcohol and or drugs and or gamble money that should have been spent on the children. Some even decide to throw in their job and become unemployed knowing that the Child Support will increase if they are employed.
Those who work in high paying positions are left paying exorbitant unfair amounts of Child Support which goes beyond the real cost of raising a child.
Child Support will also be calculated using after-tax income rather than gross.
The Formula for calculating Child Support needs to be capped at $70 569, or even lower, rather than the current $177 073, (2015). This equates to a maximum yearly cost of a single child costing approximately $11 291 ( aged 0 - 12 ) or $15 878 (13+years).
Love Australia or leave Party will lobby to make sure that the Child Support System is fairer and puts the payer first and make the payee accountable for spending.
LAOL will CAP the formula for calculating Child Support and only calculate using after-tax income rather than gross

LAOL will make accessible statements to both payer and payee available online
LAOL believes that Maintenance payments should cease if the parent refuses to grant access of the child ( except in cases where there is evidence of abuse or harm)
LAOL will make sure that the cost of a child is fixed and is NOT dependent on the level of income of the parents
